Types of Workers Compensation Benefits in Minnesota: Death/Dependency Benefits

Death/Dependency Benefits

Death benefits for the dependent spouse or other dependents include up to $15,000.00 in burial expenses and also the right of the spouse and dependents to receive from 50% to 66% of the decedent’s wage at the time of the injury. After any children are no longer dependent, the spouse will continue to receive benefits at a reduced rate for an additional ten (10) years. If there were no children, the spouse will receive benefits for ten (10) years.

Minimum Payment

For deaths on or after April 28, 2000, where dependency compensation is payable, the statute provides that a minimum of $60,000 in dependency compensation must be paid. MINN. STAT. § 176.111, SUBD. 5 (2006).

No Surviving Dependents

When an employee dies from an injury which arises out of and in the course of employment, and there are no persons entitled to monetary benefits of dependency compensation, the employer shall pay to the estate of the deceased employee the sum of $60,000.00. MINN. STAT. § 176.111, SUBD. 22 (2006).
